Terms & Conditions
The word "equipment" as used in these Terms and Conditions shall mean all containers used for storage of waste material including stationary compaction units, stationary bailing units, waste material loading devices, tanks, tankers, and such other on-site devices as may be specified on the face of this agreement. CUSTOMER'S DUTIES AND LIABILITIES. The equipment provided by Contractor is done so for contractor's convenience in providing the service called for by this Agreement. Customer shall be responsible for the cleanliness and safekeeping of the equipment. Customer shall not overload the equipment, nor use it for incineration purposes, and shall be liable to Contractor for loss or damage in excess of reasonable wear and tear. Customer warrants that waste delivered to Contractor hereunder will not contain any hazardous, highly flammable, explosive, biomedical, or toxic waste as defined by the Environmental Protection Agency or any STATE agency pursuant to the Resource Conservation and Recovery Act of 1976, as amended, or by applicable STATE law. All equipment furnished by the Contractor for use by the Customer which the Customer has not purchased, shall remain the property of the Contractor and the Customer shall have no right, title or interest in equipment. Customer agrees to defend, hold harmless and indemnify Contractor against all claims, lawsuits and any other liability of injury to persons or damage to property or the environment connected with the use of the equipment by the Customer or breach of any warranty by the Customer. On collection day, the Contractor's vehicle shall have clear access to the equipment. If the equipment is blocked to prohibit collection, Customer will be notified and one additional attempt for collection shall be made by Contractor's vehicle. Any additional collection will be classified an "extra pick-up" and so duly charged. RATE ADJUSTMENT. . Customer agrees that Premier Disposal may proportionately pass through to Customer increases in cost as a result of weights being higher than those estimated. An additional $100 will be added to rate if dumpster is used for Roofing Jobs to dispose of shingles. Rates may also be increased to reflect increase in taxes, fees or other governmental charges assessed against or passed through to Premier Disposal (other than income or real property taxes), Premier Disposal may only increase rates for reasons other than those set forth above with the consent of the Customer. Such consent may be evidenced verbally, in writing or by the actions and practices of parties. CHANGES. Changes in the Schedule of Charges, frequency of collection service, number capacity and type of equipment may be agreed to orally or in writing, by the parties. Consent to oral changes shall be evidenced by the actions and practices of the parties. DRIVEWAYS AND PARKING AREAS. Customer warrants that any right of way provided by Customer from Customer's equipment location to the most convenient public way is sufficient to bear the weight of all the contractor's equipment and vehicles reasonably required to perform the service herein contracted. Contractor shall not be responsible for damage to any private pavement or accompanying sub-surface of any route reasonably necessary to perform the services herein contracted. Material must be level at the top of the container; nothing can be sticking out of the top. If you overfill your dumpster above the top of the container, the driver will have no choice but to leave the dumpster at the property. It is unlawful to haul a dumpster with debris exceeding the top of the dumpster. If this happens be prepared to pay a ‘Dry Run Fee’ of $100.00 YOU MUST CALL US TO SCHEDULE YOUR DUMPSTER FOR REMOVAL; WE DO NOT HAVE AUTOMATIC PICK-UPS. RENTAL END DATE IS NOT THE PICKUP DATE. A CONFIRMATION IS REQUIRED IN ORDER FOR THE DUMPSTER TO BE PICKED UP. If the driver arrives on site and cannot deliver or pick up your dumpster due to locked gates, parked cars , or any physical obstruction there will be a ‘Dry Run of $75.00 If you would like to make an extension a 48 hour notice is required prior to your pickup date. Rate for extension is $10.00 / day. Maximum extension is 5 days. No Exceptions. Please keep in mind your rental has a weight limit Any weight overages will be charged at $160 / ton. If it rains or snows while the dumpster is in your possession, please understand that Premier Disposal has no control over these events. This may affect the weight of your dumpster. The customer is respons ible to provide and place a tarp, sheets of plywood or any other type of barrier over the dumpster to prevent the entry of rain or snow. If extra costs are accrued, they will be charged to the card on file after pickup automatically. The following list contains all items that are not allowed to be placed within the dumpsters. It’s not because we don’t want to take all your junk, it’s because the landfills don’t accept them or charge extra for them which we have to pass onto you. To avoid any additional charges, it’s best to stay clear of all of them. UNACCEPTABLE ITEMS. (will incur additional charges if found in the dumpster) Mattresses/Box Springs*** Tires * Televisions * Computer Monitors Batteries* Fluorescent tubes Propane tanks* Appliances that have freon or radioactive material like: Microwaves* Refrigerators* Air Conditioner (AC) units* Humidifier, Dehumidifier, Water Coolers Dirt (it’s extremely heavy and will increase your costs per extra ton dramatically)Hazardous / Industrial waste * +$35 extra charge per piece if on top of pile. Items within the pile will incur penalties. *** +$100 extra charge per piece due to new DEP law considering them as part of waste ban list. RESTRICTED ITEMS (under no circumstances are allowed in the dumpster) Solvents / Chemical products Petroleum contaminated soil/lead paint chips Herbicides and pesticides Radioactive materials Paint (except completely dried latex paint cans, no liquids) Railroad ties Medical waste Asbestos Barrels / Aerosol cans Oil filters Antifreeze Transmission oil, lubricating/hydraulic oil, oil filters, contaminated oils (mixed with solvents, gasoline, etc.) Motor oil Other flammable liquids ATTORNEY'S FEES. In the event of a breach of this agreement by either party, the breaching party shall pay all reasonable attorney's fees, collection fees and costs of the other party incident to any action brought to enforce this agreement. ASSIGNMENT AND BENEFIT. This agreement shall be binding on the parties and their successors and assigns. MISCELLANEOUS. If any conflict or differences exist in this agreement between terms which are printed and those which are typed or written, the typed or written language shall govern. ENTIRE AGREEMENT. This agreement represents the entire understanding and agreement between the parties thereto and supersedes any and all prior agreements, whether written or oral that may exist between the parties regarding same.
